Supreme Court Stays Declaration Of Rajasthan Cricket Association Election Results

The Supreme Court on Tuesday declined to stay the Rajasthan Cricket Association (RCA) elections scheduled for 11:30 a.m. but directed that the results be kept in a sealed cover pending further adjudication.

A bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice V Mohana passed the order hearing a plea by Megha Gaur alleging the complete exclusion of women from the electoral process.

Senior Advocate Menaka Guruswamy, appearing for the petitioner and identifying herself as a former Indian woman cricketer, argued that the voter list contained “not a single woman voter” or woman candidate, in violation of the RCA's 2022 Rules (specifically Article 17), the Association's own constitution, the National Sports Code, and related orders. She contended that those currently running the association were pushing the polls through in undue haste.

“This is a time when India's World Cup squad has done so well. They are world champions. Young girls are playing cricket across the country. To stifle them in the State of Rajasthan, which has a glorious cricketing tradition and has a winning IPL team, is patently opposed to anything we understand to be constitutional, just or acceptable,” Guruswamy submitted. She sought a stay of the elections and better administration of cricket in the country, noting that the absence of women on the voter list automatically precluded women candidates.

The Bench however expressed reluctance to halt the process at this stage. “Let the voting take place. We stop the declaration of results, subject to adjudication of all these issues by the Court,” Justice Bagchi said.

Counsel for the RCA and the State informed the Court that the High Court had appointed the Home Secretary as Administrator of the RCA to conduct the elections. An earlier special leave petition against the related High Court order had been dismissed, and the specific issue remained pending before the High Court. The counsel also referred to the Rajasthan Cricket Association Act.

The Supreme Court ultimately directed that the elections scheduled for the day may take place, but the results shall not be declared and shall be kept in a sealed cover. It requested the High Court to hear the case and the interlocutory application on the next date and decide the matter expeditiously. The petitioner was also granted liberty to move an interlocutory application in the pending BCCI matter before the Supreme Court, with the issues tagged accordingly.
